The Two Sides Of The 2nd Amendment

Since the beginning of time, there has been much debate about the definitions of the Second Amendment. Many people are interested in this topic because they want the truth to be known about the state’s actual ability to interpret Section 2. Many have come up with innovative and new interpretations of the second Amendment. The second amendment is now available to all.

It is important to know the background of the Framers. The Second Amendment debate had two sides. People believe it was for consolidation. This side supports stricter gun control laws. They will be less likely to commit crimes if there are stricter regulations. A stricter gun regulation can decrease crime. However, it limits the rights of those who want to own firearms and prevents them from being able to use them. Others argue that guns should be available to all people without limitation. The other side favors stricter gun control laws. They have less malefactions, and stricter regulations. While stricter gun laws may reduce malefactions, it does not stop people from wanting to possess firearms. The antithesis side claims that all citizens should be able to possess guns freely. The National Rifle Sodality is one component of this collective team. The National Rifle Association advocates for stricter gun laws to ensure that all citizens are abiding. The Second Amendment’s interpretation is the subject of much of the debate. The Bill of Rights’ Second Amendment states that ‘a well-regulated Militia is necessary for the security of an independent State. The right of the people of keeping and bearing Arms shall not be violated’. It allows people to carry arms. It is important to look back at the beginning of gun control laws in order to understand both sides. The Sullivan Act, one of the earliest gun controls laws, was enacted back in 1911. This act stated ‘…permits firearms to be carried at the discretionary of local law enforcement’. It allowed civilians to conceal a firearm that they were registered to state. This bill tested how future gun control would look. This second amendment, which allowed for more gun control, was supported by the group. It was capitalized on in 1911. The Sullivan Act was established 20 years later. This is when the conservative group began to take federal action. The 1934 National Firearms Act was passed. The 1934 National Firearms Act provided that ‘…requires full-automatic firearm registration. For breaking the law, a citizen would pay 200 dollars tax.

Homer Cummings opposed the second amendment at that time. Homers designed an orchestration that would allow each gun to be registered for each owner. The horrors of World War II made people realize they had a right for their guns to be protected. The second amendment would become a major issue. He opened the door for discussion.

Around the 1960’s, gun control was revived but with a stronger voice than ever before. People began to use the assassinations of Robert Kennedy, Martin Luther King, and JFK as a platform for their campaigns. These assassinations occurred between 1963 and 1968. Because a gun was the cause of these assassinations it provided an excellent opportunity to start pursuing Second Amendment. It gave modern liberalism a political perspective. The Vietnam War was raging at the same moment, giving citizens reason to misprize violence and guns.

People are not aware of the implications for our entire country when they make tougher gun laws.

The case of District of Columbia, v. Heller is another example of how opposing teams oppose stricter laws. This case was brought up by Dick Anthony Heller. Heller applied to have a handgun at home and received a rejection letter. He received a letter shortly after submitting his application to obtain a gun. Heller said ‘…they violated the Second Amendment right of a person to keep a functioning firearm in their home without a permit’. Heller challenged this argument. He argued that they violated his Second Amendment right to keep a functional firearm in his home without a license. Heller v. District of Columbia proved to be a huge case as the district court refused Heller’s request. The U.S. Court of Appeals reexamined the case, giving Heller a right to his rights.

School shootings, like the one in this instance, play an important role in citizens’ views of the Second Amendment. Saugus High school was attacked and killed in a shooting. Elizabeth Wolf has the details. Elizabeth Wolf is reporting on the story. This was just one of many shootings that took place across the country in 2019. Fear makes it difficult for citizens to know that even adults cannot get weapons from a minor. Many school shootings were committed by minors. Citizens are reminded of the abundance of weapons available.

But, the opposition side asserts that stricter laws would violate their Second Amendment. Other cases have also been brought up. McDonald’s v. City of Chicago is one example of a case that was raised in 2010. Otis McDonald sued Chicago after Chicago’s gun laws banned him from possessing a firearm. McDonald’s stated that ‘…generally bans the registration and makes registration a prerequisite for possession of firearms. McDonald’s claimed that this ban on handguns violated his Second Amendment. McDonald’s was favored about McDonald’s right to be a citizen by a 5-4 decision.

Beretta USA Corp. illustrates how corporations can be impacted. Maryland passed The Firearm Safety Act. This law stated ‘… limiting who can carry, transport, and wear a handgun. This limited semi-automatic rifles as well as the ammunition that citizens could carry. Soon after, Beretta decided to open another factory in Tenessee. Beretta realized how small the factory was, and decided to relocate to Tennessee. Beretta Company had over 300 employees when Maryland’s gun law was passed. Beretta gave a statement about how the law has limited their company’s growth. Beretta was among many companies that closed down permanently or moved to a friendly state.

New legislation is being considered, however, because of the number of incidents involving a particular gun. Sandy Hook Elementary School is an example. Adam Lanza was responsible for the December 14th shooting. Michael Ray claims that this shooting was ‘…fatally gunned down 20 children, six adults, and their families at Sandy Hook Elementary School. Before taking his own death, he also shot himself. Adam Lanza was a twenty-year-old man who went on an amoral rampage. His motive for the attack was not clear to police. This shooting resulted in many deaths. This made the president realize that the shooting was a serious problem. Barrack Obama quickly created a universal background screening and a limit on ammunition. Each state has its own laws regarding guns. Other states won’t. Some citizens believe that guns are not the problem, but rather the people who have control over guns.

While our Second Amendment is primarily about the U.S. Erick Puryear looked into the statistics regarding how guns have been used to commit crimes in the United Kingdom. Puryear discovered that the number of gun crimes committed by 100,000 people in the UK at 2,034 has increased over time. Puryear demonstrated that gun control laws have led to more deaths and injuries from guns.

Russia has the highest crime rate and another country with stringent gun laws. People seem to want more guns, even though there are stricter gun laws. Due to Russia and the U.K. having stricter gun laws that we have, these countries have higher rates of gun crimes than the U.S.

I favor the side with stricter gun regulations. We need stricter gun laws to regulate who can buy a weapon based on previous law violations. These include rape and murder as well as assaulting another person who should not be allowed to have guns. We have to also consider psychological aspects. Psychological breaks are not always predictable on “normal” people. However, there are extensive databases that can help to prevent shootings, murders, or any other form of gun violence from happening again.

As with all gun violence in America, accidental firearms deaths also occur. The Law Center for Gun Violence states that ‘…nine-times the number of unintentional gunshot deaths and 89% for unintentional children’s deaths is due to unintentional firearms use. We can see how negligent we are about guns by the number of children who are dying in America. The second amendment was intended to protect your home and your family, not to cause harm to them. A gun is often seen as an additional protection. However, many people don’t know what safety procedures apply to guns.

The United States gives us a home we can call our own without fear of being taken by the government. These amendments were drafted by our founding fathers to provide us with protection and freedom from the government. There were many gun control laws that addressed the issue of our right of keeping and bearing arms. The 1934 National Firearms Act imposed taxation on short-barreled rifles and automatic weapons. While many disagree with and support this idea, it is only one of many issues that this country faces. The person reading the amendment has to interpret it. This text has been interpreted by many people. It is impossible to know the original intent of the second amendment.
